A political science expert questions if the governor’s withholding of lawmakers’ pay is legal.
The Illinois Constitution says legislative salaries shall not be diminished during a term. University of Illinois Springfield political science professor emeritus Kent Redfield says lawmakers could take action should the veto stand for the rest of the term.
“Legislators would be able to sue the governor and the court would ultimately require the comptroller to write checks,” says Redfield. “You can’t not pay the legislature. “
The state’s comptroller wants a legal review of the governor’s move, and hopes it’s completed before August – when lawmakers are scheduled to get paid again.
