Sangamon County State’s Attorney John Milhiser says he cannot investigate the Springfield Police document shredding lawsuit because it’s a conflict of interest.
An appellate prosecutor has been appointed.
“Looking at the case in its entirety is a conflict, and also it’s an impropriety if I were to keep the case,” says Milhiser. “That’s one of the reason the appellate prosecutor’s office is there, to investigate these cases.”
Milhiser says he works with the police department on a number of cases, and he’s prosecuted the man bringing the suit several times on traffic violations.
The department is accused of shredding internal documents a year early, running afoul of state laws.
