It was a small victory but, a victory nonetheless for the City of Springfield.
Federal Judge Sue Myerscough dismissed a motion by Calvin Christian that the Noll Law Office be barred from representing the city in his civil rights case. As Christian was seeking a layer to represent him, he contacted the Nolls.
Myerscough said a mere phone call to a potential attorney doesn’t meet the standards of violating attorney/client privileges. Christian said he’s undeterred.
“I definitely want it to be on record that I did consult Noll Law Office in regards to this case,” said Christian. “When I talked to Noll Law Office, I felt comfortable in releasing details of the case to them.”
Christian’s federal lawsuit claims his civil rights were violated due to undue attention from Springfield Police after he requested files under the Freedom of Information Act. Christian now says police are no longer “hassling” him due to the case’s media attention.
“With several attorneys looking at what’s going on, also in regards to the document destruction, the legal action of the police chief and corporation counsel, I think more eyes are on the situation.”
